{"id":3607,"date":"2022-05-12T23:43:26","date_gmt":"2022-05-12T11:43:26","guid":{"rendered":"https:\/\/reportitnow-global.com\/nz\/new-whistleblowers-act-comes-into-force-in-july\/"},"modified":"2022-06-12T11:27:55","modified_gmt":"2022-06-11T23:27:55","slug":"new-whistleblowers-act-comes-into-force-in-july","status":"publish","type":"post","link":"https:\/\/reportitnow-global.com\/nz\/new-whistleblowers-act-comes-into-force-in-july\/","title":{"rendered":"New Whistleblowers Act comes into force in July"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h1 class=\"has-text-align-center wp-block-heading\">New Whistleblowers Act comes into force in July<\/h1>\n\n\n\n<h3 class=\"wp-block-heading\">The <a href=\"https:\/\/old.reportitnow-global.com\/2019\/06\/28\/ombudsman-most-workers-unaware-of-pda\/\">long-anticipated<\/a> Protected Disclosures Act 2022 will commence in just a few months, providing greater protections for New Zealand whistleblowers and making the disclosure process easier, says the Government.&nbsp;<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.legislation.govt.nz\/bill\/government\/2020\/0294\/latest\/whole.html\">Protected Disclosures (Protection of Whistleblowers) Act 2022<\/a> will replace the Act of 2000, providing significant improvements on the old Act, including extending and clarifying the grounds under which protected disclosures can be made.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis will greatly improve how we protect disclosers across both the public and private sectors,\u201d says Minister for the Public Service Chris Hipkins. \u201cIt is more people-focused and will make the rules easier to access, understand, and use\u201d.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">New rules<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The changes follow 2019 <a href=\"https:\/\/old.reportitnow-global.com\/2019\/06\/28\/ombudsman-most-workers-unaware-of-pda\/\">research<\/a> commissioned by the Ombudsman which found public awareness of the Protected Disclosures Act \u2018very low\u2019, and that only 40% of New Zealanders felt their jobs would be safe if they reported wrongdoing.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A further 34% of those surveyed said their job \u201cwouldn\u2019t be safe\u201d, and 27% said they were \u201cunsure\u201d what effect speaking up would have on their job security.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Applying to organisations such as small businesses, government agencies, and non-government associations, the new Act will include new rules around confidentiality about individuals who have made the disclosure, immunity from disciplinary action for those making a disclosure, and will offer protection from retaliation through the Employment Relations Act 2000 and the Human Rights Act 1993.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Next steps<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Bill is now awaiting Royal Assent and will commence in July. In the interim, the Government says it will work to build awareness of the new legislation, so that both organisations and the individuals within them understand what protections are available.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s vital that employees and workers can freely speak up when they have concerns about ethics, risks, financial impropriety and safety in the workplace \u2013 without the fear of recrimination.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new Act covers wrongdoing in, or by, any organisation, including small businesses, government agencies, and non-government associations and is relevant to anyone who has worked or volunteered for them, says Hipkins.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAnother key improvement to the Act means a person, from any organisation or business, can make a protected disclosure direct to an appropriate authority at any time \u2013 instead of needing to disclose to their employer first,\u201d Chris Hipkins said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Read the bill <a
