{"id":3805,"date":"2022-10-19T14:09:08","date_gmt":"2022-10-19T01:09:08","guid":{"rendered":"https:\/\/reportitnow-global.com\/nz\/?p=3805"},"modified":"2022-10-19T14:12:58","modified_gmt":"2022-10-19T01:12:58","slug":"whistleblower-and-workplace-ethics-in-2022","status":"publish","type":"post","link":"https:\/\/reportitnow-global.com\/nz\/whistleblower-and-workplace-ethics-in-2022\/","title":{"rendered":"Workplace ethics and the whistleblower in 2022"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Surging reports of workplace incivility, employee ambivalence about reporting misconduct and a raft of new international whistleblower legislation, here\u2019s our October round up of the latest developments and research in the world of ethics and compliance\u2026<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">New whistleblower legislation<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>New Zealand<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">New Zealand\u2019s Protected Disclosures (Protection of Whistleblowers) Act 2022 is now law. It increases protections for whistleblowers and extends the grounds under which <a href=\"https:\/\/reportitnow-global.com\/nz\/protection-of-whistleblowers-act\/\">protected disclosures<\/a> can be made.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law extends the definition of \u2018serious wrongdoing\u2019 to include any act, omission or course of conduct in or by an organisation that poses a \u201cserious risk to the health and safety of any individual\u201d. This means that \u2018serious wrongdoing\u2019 could now include instances of bullying and harassment in the workplace.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To discuss how the changes affect your organisation, <a href=\"https:\/\/reportitnow-global.com\/nz\/contact\/\">contact Report it Now<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Australia<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Following the Australian Human Rights Commission\u2019s Respect@Work inquiry into <a href=\"https:\/\/reportitnow-global.com\/au\/au-leaders-must-commit-to-organisations-free-from-sexual-harassment-free-now\/\">sexual harassment<\/a>, the Federal Government is preparing to adopt seven more of the 55 proposed legislative changes, to create a new legal and regulatory model that is \u201cevidence-based, victim-focused and framed through a gender and intersectional lens\u201d.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The changes aim to shift current approaches to sexual harassment in the workplace from a reactive, complaints-based approach, to a \u201cpostive duty\u201d, and one which requires preventive actions from employers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Compliance will be enforced by The Queensland Human Rights Commission.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cUp until now, Australian workplaces have not sufficiently addressed sex discrimination, harassment and victimisation,\u201d says Report It Now\u2019s Petrina Maxwell.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe new legislation puts the responsibility squarely on employers to prevent sexual harassment in the workplace, and that goes beyond updating policies and procedures.\u201d&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe legislation is expected to be passed at any time, so businesses should make sure they\u2019re compliant now,\u201d says Maxwell.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Japan<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In June this year, Japan made amendments to its Whistleblower Protection Act, the law that&nbsp; provides protection for employees who have reported ethical issues in the workplace.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The amended act now includes a mandatory obligation for companies of a certain size to implement a whistleblower system and protect whistleblowers.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new legislation however only loosely applies to smaller companies &#8211; operators with 300 or less employees are only required to \u201cmake efforts\u201d to establish a whistleblowing system.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">New whistleblowing regimes have also been established in <a href=\"https:\/\/www.globallegalpost.com\/news\/dubais-new-whistleblowing-regime-what-you-need-to-know-907534576\">Dubai<\/a>, and a new Whistleblower Protection Act is currently in legislative process in Germany.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Changing landscape for misconduct<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Remote working is continuing to change the workplace landscape. According to <a href=\"https:\/\/www.gartner.com\/en\/newsroom\/press-releases\/2022-06-15-gartner-says-the-pandemic-has-reduced-compliance-reporting-30-percent\">research from Gartner<\/a>, remote employees observe about 11% less misconduct than their in-office peers. Instances of bullying, intimidation and unwanted behaviour however, is around 7% higher for remote workers, says Gartner.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe increase in remote and hybrid working practices has reduced the amount of misconduct and the potential to observe it,\u201d comments Audet, \u201chowever, what we see in the data is more complex: misconduct such as gifts and entertainment, and travel abuse is falling, but things such as intimidation and unwanted behaviour are on the rise.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Worker ambivalence<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Not only are remote workers less likely to observe misconduct, they are also less likely to report it when they do.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cSince the pandemic, employees are a lot less likely to speak up if they sense something is wrong,\u201d says Chris Audet, senior director, research at Gartner.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cA culture where employees don\u2019t think others are reporting misconduct has negative implications for the business. Employees are less likely to see their company as ethical, less likely to think the company cares about them, and less likely to be engaged in their jobs.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" width=\"1000\" height=\"576\" src=\"https:\/\/reportitnow-global.com\/nz\/wp-content\/uploads\/sites\/2\/2022\/10\/amb.jpg\" alt=\"\" class=\"wp-image-3807\" srcset=\"https:\/\/reportitnow-global.com\/nz\/wp-content\/uploads\/sites\/2\/2022\/10\/amb.jpg 1000w, https:\/\/reportitnow-global.com\/nz\/wp-content\/uploads\/sites\/2\/2022\/10\/amb-300x173.jpg 300w, https:\/\/reportitnow-global.com\/nz\/wp-content\/uploads\/sites\/2\/2022\/10\/amb-768x442.jpg 768w\" sizes=\"(max-width: 1000px) 100vw, 1000px\" \/><figcaption>Source: Source: Gartner (June 2022)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">And the trend doesn\u2019t just apply to remote workers. Around half of employees don\u2019t feel a moral obligation to report compliance violations. These employees say they are taking a pragmatic &#8211; rather than idealistic &#8211; approach to reporting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt may surprise many compliance leaders to know that just 54% of employees feel that reporting workplace misconduct is the right thing to do,\u201d says Chris Audet, senior director, research, at Gartner.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cEmployees understand it is what they are supposed to do but in many cases, they aren\u2019t sure that doing so will work out well for them or their teams, so they choose to keep quiet.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Civility issues come to the fore<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Data from NAVEX\u2019s 2022 benchmark report shows a sharp rise in workplace civility-related issues, especially retaliation, harassment, and discrimination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cReports about harassment, discrimination and retaliation are all rising,\u201d says the report, \u201cand employees now have numerous incentives to take their concerns outside the company to regulators, plaintiff lawyers or the media.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cCompliance officers should look at their training materials closely \u2013 including training&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">specifically for managers, who play a crucial role receiving reports and preventing retaliation.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">With changing employee attitudes, a pressured labour market and the disruption of the Covid pandemic, a new emboldened employee is emerging. In fact, fewer and fewer whistleblowers are choose to report anonymously.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cNoting \u2018The Great Resignation\u2019 and the intense hiring competition, employees who are confident that they could more easily secure other employment may be more emboldened to speak up,\u201d says the report.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Whistleblower options: digital channels<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Research continues to show that multiple <a href=\"https:\/\/reportitnow-global.com\/nz\/what-is-a-whistleblowing-hotline\/\">channels for whistleblowing<\/a> &#8211; especially digital channels &#8211; is crucial for promoting a healthy culture where ethical reporting is normalised.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Globally, 46% of organisations say they receive the majority of their reports via web and mobile whistleblowing channels. Telephone hotlines are th second most prevalent method at 30%, up from 2020 and close to pre-pandemic levels.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Anti-fraud control work<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As reported earlier in the year, the presence of anti-fraud controls is closely associated with lower losses from fraud and quicker fraud detection, says the <a href=\"https:\/\/reportitnow-global.com\/nz\/acfe-report-to-the-nations-2022\/\">ACFE Report to the Nations 2022<\/a>.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"\"><\/a><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"1024\" height=\"585\" src=\"https:\/\/reportitnow-global.com\/nz\/wp-content\/uploads\/sites\/2\/2022\/10\/New-1024x585.jpg\" alt=\"\" class=\"wp-image-3806\" srcset=\"https:\/\/reportitnow-global.com\/nz\/wp-content\/uploads\/sites\/2\/2022\/10\/New-1024x585.jpg 1024w, https:\/\/reportitnow-global.com\/nz\/wp-content\/uploads\/sites\/2\/2022\/10\/New-300x171.jpg 300w, https:\/\/reportitnow-global.com\/nz\/wp-content\/uploads\/sites\/2\/2022\/10\/New-768x439.jpg 768w, https:\/\/reportitnow-global.com\/nz\/wp-content\/uploads\/sites\/2\/2022\/10\/New.jpg 1207w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><figcaption>Source: ACFE Report to the Nations 2022<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWith their high success rate and low implementation cost, all organisations should have a tip hotline or mechanism to report fraud,\u201d says the report. \u201cWhile in the past hotlines were phone lines that employees could call to anonymously report fraud, hotlines today can include forms on a webpage or a special email set up to collect tips.\u201d<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Report It Now helps businesses build ethics programmes, provides customised&nbsp; training services and <a href=\"https:\/\/reportitnow-global.com\/nz\/ethicspro\/\">enterprise case management software<\/a>.
