Simply put, it aims to protect people who raise concerns about possible wrongdoing in the workplace.\u00a0<\/strong><\/p>\n<p><span style=\"font-weight: 400\">It also provides redress for employees who are dismissed or otherwise penalised for having reported possible wrongdoing in the workplace. The Act sets out the procedures that should be followed when making a disclosure, and provides protection to employees who do.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400\">When is a disclosure protected?\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400\">A disclosure is protected if:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The information is about serious wrongdoing\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The employee reasonably believes the information is true or likely to be true, and<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The employee wants the serious wrongdoing to be investigated<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">A disclosure is <em>not<\/em> protected if:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The allegations are false<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The person making the claim is acting in bad faith, or<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The information being disclosed is subject to legal professional privilege<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400\">So what counts as \u2018wrongdoing\u2019?\u00a0<\/span><\/h3>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Criminal offences<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Unlawful, corrupt or irregular use of public money or resources<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Conduct that poses a serious risk to public health, safety, the environment or the maintenance of the law<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Gross negligence or mismanagement by public officials<\/span><\/li>\n<\/ul>\n<p><a href=\"https:\/\/reportitnow-global.com\/wp-content\/uploads\/2020\/01\/discl2.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-1419\" src=\"https:\/\/reportitnow-global.com\/wp-content\/uploads\/2020\/01\/discl2.jpg\" alt=\"\" width=\"1024\" height=\"452\" srcset=\"https:\/\/reportitnow-global.com\/sg\/wp-content\/uploads\/sites\/4\/2020\/01\/discl2.jpg 1024w, https:\/\/reportitnow-global.com\/sg\/wp-content\/uploads\/sites\/4\/2020\/01\/discl2-300x132.jpg 300w, https:\/\/reportitnow-global.com\/sg\/wp-content\/uploads\/sites\/4\/2020\/01\/discl2-768x339.jpg 768w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/a><\/p>\n<h3><span style=\"font-weight: 400\">How are employees protected under the Act?\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400\">According to the Act, no civil, criminal, or disciplinary proceedings can be taken against employees for making a protected disclosure or for referring one to an appropriate authority.<\/span><\/p>\n<p><span style=\"font-weight: 400\">If an employee <em>does<\/em> suffer retaliatory action from an employer after making a protected disclosure, they can take personal grievance proceedings under the <\/span><a href=\"http:\/\/www.legislation.govt.nz\/act\/public\/2000\/0024\/latest\/DLM58317.html\"><span style=\"font-weight: 400\">Employment Relations Act<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Under the <a href=\"http:\/\/www.legislation.govt.nz\/act\/public\/1993\/0082\/latest\/DLM304212.html\">Human Rights Act<\/a> employees cannot be treated less favourably than others in the same or similar circumstances. Whistleblowers who are victimised in this way may have legal remedies under the Human Rights Act.<\/span><\/p>\n<h3><span style=\"font-weight: 400\">Why should organisations have a policy for dealing with disclosures?\u00a0\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400\">\u201cAn internal policy is a critical starting point for organisations to demonstrate their commitment to support the reporting of wrongdoing by staff, and proper handling of these matters when they are raised,\u201d says the Ombudsman.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cThis commitment should be formally adopted as organisational policy and widely communicated to all staff.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cThis guidance is equally applicable to private sector organisations.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">An organisation\u2019s policy should therefore include\u00a0<\/span>a commitment to maintaining up-to-date procedures which set out the steps for employees and staff members when handling a disclosure, as well as\u00a0a commitment that the person making the disclosure\u00a0will be kept informed of the progress and outcome of their disclosure.<\/p>\n<h3><span style=\"font-weight: 400\">What is the first step employees take when making a disclosure?<\/span><\/h3>\n<p><span style=\"font-weight: 400\">Employees should start by following their organisation\u2019s procedures for dealing with serious wrongdoing. Ideally this will involve an independent, <\/span><a href=\"https:\/\/www.reportitnow.co.nz\/\"><span style=\"font-weight: 400\">external whistleblowing service<\/span><\/a><span style=\"font-weight: 400\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">If a company doesn&#8217;t have a procedure in place, employees can make disclosures to the head of the organisation or, in urgent or exceptional circumstances, or if there\u2019s been no action or recommended action within 20 working days of a disclosure, to an appropriate authority.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Research shows having an independent and confidential whistleblowing hotline or web-based system successfully minimises risk from unethical behaviour.
