Failure to comply carries penalties.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Broadly speaking, the <\/span><a href=\"https:\/\/www.legislation.gov.au\/Details\/C2019A00010\"><i><span style=\"font-weight: 400\">Treasury Laws Amendment (Enhancing Whistleblower Protections) Act 2019<\/span><\/i><\/a><span style=\"font-weight: 400\"> seeks to \u201cconsolidate and broaden the existing protections and remedies for corporate and financial sector whistleblowers\u201d as well as \u201ccreate a whistleblower protection regime for disclosures of information by individuals regarding breaches of the tax laws or misconduct relating to an entity\u2019s tax affairs\u201d.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Specifically, the reforms:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">broaden the whistleblower definition to include both current and former employees, officers, and contractors, as well as their spouses, dependants, and other relatives, and anonymous disclosures<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">extend the protections to whistleblower reports that allege misconduct or an improper state of affairs or circumstances about any matter covered by financial sector laws and all Commonwealth offences punishable by imprisonment of 12 months or more<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">create civil penalty provisions, and in addition to the existing criminal offences, for causing detriment to (or victimising) a whistleblower and for breaching a whistleblower&#8217;s confidentiality<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">give protections for whistleblowers in certain circumstances if they go public with concerns about dangers to the public or matters in the public interest<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">provide whistleblowers with easier access to compensation and remedies if they suffer detriment<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">remove the requirement for a whistleblower report to satisfy a &#8216;good faith&#8217; test to access the protections, though a report solely about a personal workplace grievance is not covered by the protections, and<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">from 1 January 2020, require all public companies, large proprietary companies, and corporate trustees of registrable superannuation entities to have a whistleblower policy.<\/span><\/li>\n<\/ul>\n<p><a href=\"https:\/\/reportitnow-global.com\/wp-content\/uploads\/2019\/06\/reg-2.jpg\"><img decoding=\"async\" class=\"alignnone size-full wp-image-1250\" src=\"https:\/\/reportitnow-global.com\/wp-content\/uploads\/2019\/06\/reg-2.jpg\" alt=\"\" width=\"1176\" height=\"457\" srcset=\"https:\/\/reportitnow-global.com\/uk\/wp-content\/uploads\/sites\/6\/2019\/06\/reg-2.jpg 1176w, https:\/\/reportitnow-global.com\/uk\/wp-content\/uploads\/sites\/6\/2019\/06\/reg-2-300x117.jpg 300w, https:\/\/reportitnow-global.com\/uk\/wp-content\/uploads\/sites\/6\/2019\/06\/reg-2-1024x398.jpg 1024w, https:\/\/reportitnow-global.com\/uk\/wp-content\/uploads\/sites\/6\/2019\/06\/reg-2-768x298.jpg 768w\" sizes=\"(max-width: 1176px) 100vw, 1176px\" \/><\/a><\/p>\n<p><span style=\"font-weight: 400\">\u201cRespect and fair treatment for whistleblowers, commitment to address whistleblower concerns, and reporting of whistleblower concerns to senior executives and board members will assist a company to manage itself, comply with its obligations, and improve its performance,\u201d says ASIC of the amendments.\u00a0<\/span><\/p>\n<p><b>Next steps<\/b><\/p>\n<p><span style=\"font-weight: 400\"><a href=\"https:\/\/www.reportitnow.co.nz\/\">Update your whistleblower policies<\/a> and processes to ensure that they comply with the new regulations now.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">New whistleblower policies should contain:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">information about the protections available to whistleblowers, including protections under the law<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">information about how and to whom disclosures should be made. \u201cThis will be important for whistleblowers to be sure of the company\u2019s arrangements, given that a company can authorise particular staff or third parties to receive disclosures from whistleblowers\u201d.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">information about how the company will support whistleblowers and protect them from detriment<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">information about how the company will investigate disclosures that qualify for protection under the law.
